Photography contract template for India (free, clause by clause)
Most Indian studios work on an approved quotation and an advance — which is fine until a date changes, a function is added 'on the phone', or a client demands raw footage in month six. A one-page terms sheet attached to every quotation prevents almost all of it.
Below is a practical clause-by-clause template used by Indian agencies. Copy it, fill the blanks, and attach it to every booking. (This is a working template, not legal advice — have a lawyer review your final version.)
1. Parties & scope
- This agreement is between ______ Studio ('the Studio') and ______ ('the Client') for photography/videography services for the events listed in Quotation No. ______ dated ______.
- Coverage, team size, hours and deliverables are exactly as itemised in the quotation — the quotation is part of this agreement.
- Any addition (extra function, extra hours, drone, extra album) is chargeable and confirmed in writing (WhatsApp acceptable) before the event.
2. Payments
- Booking is confirmed only on receipt of ___% advance; dates remain open until then.
- Second instalment of ___% is due on or before the first event day; balance before delivery of final edited photos/films.
- All payments are non-refundable except as per the cancellation clause below. GST extra as applicable.
3. Cancellation & date changes
- Client cancellation: advance is non-refundable (it blocks peak dates). Cancellation within 30 days of the event: ___% of total is payable.
- One date change is accommodated free if informed ≥45 days before the event and the new date is available; otherwise treated as cancellation + rebooking.
- Studio cancellation (non-force-majeure): full refund of all amounts paid, plus reasonable help finding a replacement team.
4. Deliverables & timeline
- Edited photos: ______ count, delivered within ___ weeks of the last event via online gallery.
- Film(s): ______ minutes (highlight) / ______ (full), delivered within ___ weeks.
- Album: ______ spec, delivered within ___ weeks of client photo selection; selection within 21 days keeps the delivery date.
- One revision round on album design and film is included; further rounds at ₹______ per round.
5. Raw footage & image rights
- Raw/unedited files are not deliverables and remain Studio property; raws are archived for ___ months after delivery, then may be deleted.
- The Studio may use selected images/films for portfolio and social media; the Client may opt out in writing before the first event.
- The Client receives full personal-use rights to all delivered media; commercial use by third parties (venues, planners, brands) requires the Studio's consent.
6. On-ground requirements & force majeure
- The Client arranges vendor meals and reasonable travel/stay for outstation events as itemised in the quotation.
- The Studio is not liable for missed moments caused by venue restrictions, guest interference, or schedule changes not communicated in writing.
- Force majeure (illness, accident, natural events, government restrictions): the Studio will first provide an equivalent replacement team; if impossible, amounts for unrendered services are refunded.
- Equipment failure: the Studio carries backup equipment; liability in any case is limited to amounts paid by the Client.

Frequently asked questions
Is a WhatsApp approval legally useful in India?
Written electronic acceptance (email/WhatsApp of an offer with clear terms) is far stronger than a verbal yes and is routinely relied upon. A signed contract is stronger still — use this template for high-value bookings.
Should I promise raw footage?
Most studios don't — raws are unfinished work and huge to store. If a client insists, price it as a separate line item with a stated format and archive period.
